NTS Terms of Service
This Terms of Service ("Terms") governs your use of the ePAY Card (the "Card") issued by Norbrook Transaction Services Limited - ePAY ("we," "us," or "our"). By registering and or using the Card, you (the "Cardholder" or "you") agree to be bound by these Terms.
If you object to this Agreement or any subsequent modifications to it, or become dissatisfied with your use of the Website in any way, your only remedy is to immediately: (a) discontinue your use of the Website; and (b) terminate your membership by notifying us in writing.
Card Use
The Card is a reloadable card intended for use at authorized school cafeterias, corporate canteens, vending machines, and other approved merchants whether external or within participating schools (the "Schools") and organizations (the "Company").
You can use the Card to make purchases by swiping, tapping, QR scanning it at the designated point-of-sale terminal.
Card Activation and Top-Up
Card activation and top-up can be done online at www.epayja.com or through authorized channels designated by the School. Parents or guardians (the "Cardholder Representative") will be responsible for activating and topping up the Card on the Cardholder's behalf.
Funds and Refunds
Funds loaded onto the Card are pre-paid and non-refundable except as required by law. Lost or stolen Cards will be deactivated, and any remaining balance may be transferred to a replacement Card upon verification and approval by us.
Data Protection
We are committed to protecting the privacy of your personal information. We collect, use, and disclose your personal information in accordance with the Data Protection Act, 2020 (the "DPA") of Jamaica.
- Your Rights under the DPA: You have certain rights under the DPA, including the right to access and correct your personal information.
We will only collect and use personal information necessary for the operation of the Program and will take all reasonable steps to protect your information from unauthorized access, use, or disclosure.
Cardholder Representative Responsibilities
The Cardholder Representative is responsible for:
- Safeguarding the Card and keeping it in the Cardholder's possession.
- Monitoring Card transactions and notifying us of any unauthorized activity.
- Informing us of any changes to the Cardholder's contact information.
- Educating the Cardholder on the proper use of the Card according to these Terms.
Disclaimer of Warranties
THE CARD AND THE PROGRAM ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
WE WILL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE CARD OR THE PROGRAM, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Termination
We may terminate your use of the Card or the Program at any time for any reason, with or without notice. You may also terminate your use of the Card at any time by surrendering the Card to the School or contacting us.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Jamaica.
Amendments
We may amend these Terms at any time by posting the amended Terms on our website or through other appropriate means. Your continued use of the Card after the posting of any amended Terms constitutes your acceptance of the amended Terms.
